DMV Set Aside for Under 21 Driver – .18%/.18% BAC

Client was under 21, and submitted to 4 breath tests, all well over .01% (the law for under 21 drivers is 01%). At the hearing, we presented evidence that the arresting officer failed to comply with Title 17 of the California Code of Regulations in administering all four breath tests, and the suspension was set aside. Client was facing a one-year hard suspension due to being under 21.
