DMV Refusal Win for Out of State Driver

Client (a Marine Corps veteran) is stopped in Old Town Temecula for some bogus equipment violation on a rental car. The sheriff gives him a hard time, and arrests him. The sheriff claimed the client refused chemical testing, which could have resulted in a one-year revocation of the client’s license. After careful review of the body-worn camera, we determined the sheriff failed to comply with the law and the suspension was set aside.
