Client was involved in a serious collision in which his teeth were broken, and his gums were bleeding profusely. Despite this, the police administered two breath tests to the client, while his mouth was actively bleeding. The breath test reported results of .15%/.15%. At the hearing, we called our expert forensic toxicologist, who explained the test results were unreliable, and the administration of the tests violated Title 17 of the California Code of Regulations. No license suspension.
